The Real Skinny on Standing | Find Attorneys | Lawyer Referral ...

by Find Lawyers on February 27, 2012

Here's the Real Skinny on Standing and why it doesn't apply to traffic tickets. Standing is mainly a civil issue, not a criminal issue. The voluntaryists want you to believe the government needs to show injury or loss to give you a traffic ticket, but this is not true. You only need to show injury or loss to recover damages in a civil court. Fines for traffic violation are not damages, they are punishment for violation of law. Whether or not you believe the government should be able to punish its citizens for violating the law is an interesting topic for discussion, but it has nothing to do with standing, which is almost entirely a civil issue. If you need legal advice for beating a traffic ticket, you should consult a lawyer. You should not listen to YouTube videos that claim a person can beat any traffic ticket by making an argument in court that involves Standing or Corpus Delicti. The posters are not legal experts and their advice could cause you further legal trouble.
