Mike Johanns To Support Chuck Hagel For Defense Secretary: Report

Sen. Mike Johanns (R-Neb.) will support his former colleague Chuck Hagel's nomination for U.S. defense secretary, the Lincoln Journal Star reported Saturday.

Hagel, a former Republican senator from Nebraska, faced about eight hours of tough questioning on Thursday during his confirmation hearing in front of the Senate Armed Services Committee. The White House defended Hagel's performance on Friday, maintaining that the former senator will garner enough votes for confirmation.

As the Omaha World-Herald reported last month, many eyes have turned to the GOP senators from Hagel's home state, Johanns and Deb Fischer.

?Chuck Hagel?s military career is nothing short of admirable and while he has been a long-time friend, we do have very different opinions on many very important issues," Johanns said in a statement after Obama announced his nomination of Hagel. "Now that he has been nominated, he has an obligation to elaborate on his past statements and fully explain his positions during what I expect to be a thorough and fair confirmation hearing."

Earlier this week, Johanns signaled that he was leaning towards supporting Hagel.

"It sure seems to me that this has gone well," Johanns told the Journal Star after meeting privately with Hagel ahead of the confirmation hearing. At the time, Johanns said he would reserve his final decision until after the hearing.

Johanns is the second Republican to back Hagel. The first was Sen. Thad Cochran (R-Miss.), who endorsed Hagel on Tuesday.

A committee vote on Hagel may come as early as next Thursday. Democrats hold a 14-12 edge on the Senate Armed Services Committee.

Creditors in Alabama bankruptcy to miss February 1 payment

BIRMINGHAM, Alabama (Reuters) - A lawyer for the creditors' trustee in America's biggest municipal bankruptcy on Friday said the trustee will not make a February 1 payment to owners of $3.14 billion of sewer debt issued by Alabama's Jefferson County.

Gerald Mace, an attorney for creditors' trustee Bank of New York Mellon, told a bankruptcy court hearing that the distribution could not be made because of a "lack of funds".

In a document filed on the Electronic Municipal Market Access (EMMA) on Friday, BNY Mellon lists as oustanding approximately $3.1 billion in principal of sewer revenue warrants affected.

The notice explains that "certain holders of bank warrants are not willing, at this time, to consent the trustee making distributions of principal with respect to Sewer Warrants coming due at maturity or resulting of mandatory sinking fund redemption in February and early March 2013...."

The county continues to make payments from sewer-system revenues to Bank of New York, which distributes the money to debt owners that include Wall Street banks, insurance companies and hedge funds, Jefferson County Manager Tony Petelos told reporters.

Lawyers for creditors and Jefferson County, which filed for Chapter 9 bankruptcy in 2011 mainly because of overwhelming debt on its sewer system, are battling in court over sewer fee hikes that would go in part to service the sewer warrants.

Creditors say a 5.9 percent increase in fees authorized in November by county officials was too low and are asking the judge overseeing the case for clearance to press a state court lawsuit for bigger hikes they say are needed to pay off the debt.

JPMorgan Chase, Bank of New York and other creditors are proposing hikes of 22 percent or more. County officials have said the November hike would raise system revenue by $8.5 million a year and could be followed by other increases as part of a settlement with creditors.

Journalist fights request to testify in Colorado shooting case

DENVER (Reuters) - A Fox News journalist ordered to testify about confidential sources used in a story about the Colorado theater shooting will fight the ruling, court papers showed on Thursday.

Arapahoe County District Judge William Sylvester asked that New York-based journalist Jana Winter testify about a story on a notebook linked to accused gunman James Holmes, which went out days after a court-imposed gag order went into effect.

Holmes, a 25-year-old former neuroscience doctoral student at the University of Colorado, is accused of killing 12 people and wounding 58 others at the July screening of a Batman movie in the Denver suburb of Aurora.

The massacre ranks as one of the worst cases of U.S. gun violence in recent years.

The Fox News story, citing two unidentified law enforcement sources, gave details on the contents of a notebook that purportedly contained plans for mass murder that Holmes sent to university psychiatrist Lynne Fenton.

Holmes' attorneys argue the story could prejudice potential jurors against their client. Their request to have Winter testify represents a rare attempt to force a journalist to reveal anonymous sources when it is suspected that an official has illegally shared information.

Winter's lawyer, Dori Ann Hanswirth, said in a letter dated on Tuesday that she planned to aggressively fight attempts to force her client to testify. The letter was released by the court on Thursday.

Winter will "assert all legal redress available to her," Hanswirth wrote, including objecting to proceedings brought in New York or Colorado to compel her to testify and invoking legal provisions to shield journalists from such requirements.

More than a dozen law enforcement officers who saw the package containing the notebook in a university mail room have denied under oath they were a source for the Fox News story.

Prosecutors have said the attempt to obtain Winter's testimony could delay the trial.

Judge Sylvester set an April 1 court hearing to discuss the attempt by Holmes' attorneys to have Winter testify in the case.

Gabe Newell says challenge is to break into living room before Mac takes over

If Gabe Newell is to believed, the biggest threat facing the living room PC is Apple.

The founder and head of PC gaming icon Valve spoke of his company's plans to introduce its "Steam Box" to what was once the domain of game consoles at the University of Texas' LBJ School of Public Affairs

"The threat right now is that Apple has gained a huge amount of market share, and has a relatively obvious pathway towards entering the living room with their platform," said Newell as reported by Polygon.

"I think that there's a scenario where we see sort of a dumbed down living room platform emerging ? I think Apple rolls the console guys really easily. The question is can we make enough progress in the PC space to establish ourselves there, and also figure out better ways of addressing mobile before Apple takes over the living room?"

This might sound a bit paranoid, but if Apple were to put its own living room platform forward with the hardware capable of even mid-core games it would cause at least as much disruption as Nintendo's Wii did at launch

Newell says that those wanting to distribute a living room PC will have to ride on the strengths of their hardware: bigger hard drives, coustomizable form factors, and offering support for hardware the user might already own.

He isn't just talking about other companies innovating in the PC space for the sake of rhetoric either.

"I think a whole bunch of hardware companies are going to be releasing products in the next 12 months ? you'll hear it referred to as Miracast, Shield from Nvidia, or lots of other people," said Newell.

"There are going to be a huge set of products that say, 'If you want something that's incredibly cheap, at a price point well below anything that consoles will be able to reach, you're going to take advantage of the PC that's running somewhere in your house.'

"It's like one of those things where afterwards it will seem like it was very simple, when beforehand, everyone sort of denied that it was possible."

Though Valve definitely has the initiative with its Linux-powered Steam box and third party manufacturers already lined up to take advantage of its model of the living room PC platform, it won't be long before others join in.

"We're happy to do it if nobody else will do it, mainly because everybody else will pile on, and people will have a lot of choices, but they'll have those characteristics," said Newell.

"They'll say, 'Well, I could buy a console, which assumes I'll re-buy all my content, have a completely different video system, and, oh, I have a completely different group of friends, apparently. Or I can just extend everything I love about the PC and the internet into the living room.'"

To Newell this makes the question of competition from consoles besides the point; the only thing that can really dint Valve's hopes is Apple getting a hold of the market before its own solution can take root.

"The biggest challenge I don't think is from the consoles," Newell said. "I think the biggest challenge is that Apple moves on the living room before the PC industry sort of gets its act together."
